Turner ORDINANCE NO. 9729 AN ORDINANCE CLOSING AND ABANDONING WARREN STREET LOCATED SOUTHWEST OF MISSISSIPPI AVENUE, SOUTHEAST OF TREMONT STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Warren Street located southwest of Mississippi Avenue, southeast of Tremont Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Warren Street, a 50 foot wide unopened right-of-way. To find the true point of beginning of said unopened street, start on the southwest line of Mississippi Avenue 145 feet southeast of the intersection of the southwest line of Mississippi Avenue with the southeast line of Tremont Street, said point being the intersection of the southwest line of Mississippi Avenue with the northwest line of Warren Street, thence southwest 170 feet with the northwest line of Warren Street to the northeast corner of lot 16, block 1, Map No. 1, Chattanooga Land, Coal, Iron, and Railway Company's Subdivision of North Chattanooga, as shown by plat of record in plat book 3, page 31, R.O.H.C., the true point of beginning, thence continuing southwest 253.8 feet with the northwest line of Warren Street and the southeast line of lots 16, 15, 14, 13, 12, and 11, block 1, said subdivision, to the southeast corner of said lot 11, thence southeast some 55 feet to the southeast line of Warren Street at the most westerly corner of lot 5, block 2, said subdivision, said point being 26 feet northwest of the northwest corner of lot 4, block 2, said subdivision, thence northeast some 195.5 feet with the southeast line of Warren Street and the northwest line of lots 5 and 6, block 2, to the southwest line of a 10 foot alleyway, thence northwest some 54 feet to the northwest line of Warren Street, the true point of beginning. Tax Map No. 136A-D-26 and 27, and 136A-E-1 and 30. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 4. The property adjacent to said right-of-way shall be resubdivided to prevent any land-locked parcels and a turnaround be constructed as approved by the City Traffic Engineer. 5. The areas reserved for utility easements must be kept free and clear of all structures. 6. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law, provided that this Ordinance shall not be effective until completion of condition no. 4 in Section 2 above.
